The a u t h o r discusses t h e well k n o w n inscription of Dmeir (ed. P. R o u s s e l a n d F . d e Y i s s c h e r , Les inscriptions du temple de Dmeir, Syria 23 [1942—43] 173 ff.) being a p a r t of the record f r o m a trial which took place in the year 216 in Antiochia before the E m p e r o r Caracalla. According to t h e a u t h o r it was not a delayed appeal b u t a case where omitting the viceroy's court tlie plain-tiff addressed directly the E m p e r o r w i t h his εντευξις in order to p u t his case, which u n d o u b t e d l y had f o r m e r l y been carried b y so-me lower instances, directly before t h e E m p e r o r ' s tribunal. T h e adversaries contradicted this behaviour f r o m t h e v e r y beginning. Since however t h e E m p e r o r declared himself to be r e a d y to exa-mine b o t h parties the adversaries were compelled to follow the s u m m o n s before t h e E m p e r o r ' s court. T h e n t h e y raised a p r o t e s t in t h e procedural f o r m of παραγραφή.

O n t h e basis of his investigation the a u t h o r comes to the con-clusion t h a t this p a p y r u s is of no concern w i t h t h e right to the ransom of t h e confiscated land and gives t h e following translation of t h e t e x t " P é t é a r o ê r i s to D a i m a c h o s " : " I have to complain of the injustice of Pempsais. Once m y wife owned 80 arourae of land which did n o t suffer f r o m inundations. I n t i m e of disorder she took re-f u g e in t h e Delta and came b a c k only w h e n t h e regulations rere-fer- refer-ring to t h e a b a n d o n e d land b e c a m e irrevocable. Owing to those regulations Pemsais b e c a m e owner of 53 arourae of the original area. I now perceive t h a t he a p p r o p r i a t e d 27 arourae beyond t h e acquired b y sale ones, which legally belong to m y wife a n d t o me as her h e;r . I ask you t h e n t o r e c o m m e n d t o t h e local author-ties
to s u b m i t a r e p o r t on this s u b j e c t a n d to bring a b o u t m y being able to trace t h e limits between w h a t belongs to me and to P e m -p s a i s " .
