INTRODUCTION TO CRIMINAL LAW - ASSESMENT RULES AND CLASSES SCHEDULE

• Each class will cover a certain basic, underlying princinple of criminal liability.

• Discussed principles stem from the European Convention of the Human Rights

• Each class will start with a short introduction delivered by the lecturer – explanation of basic concepts and assumptions connected to the analysed principle

• During each class students will give presentations concerning chosen ECHR judgments. Judgments suggested by the lecturer focus on detailed issues associated with the analysed principle.

• Presentations will be followed by a discussion.

Detailed schedule

Class 1: Introduction. Scope of the course. European Convention on Human Rights – basics

Class 2: Art. 3 ECHR. Prohibition of torture.

Class 3: Art. 5 ECHR. Right to liberty and security. Pre-trial detention Class 4: Art. 6 ECHR. Right to a fair trial. Part I

Class 5: Art. 6 ECHR. Right to a fair trial. Part II Class 6: Art. 7 ECHR. No punishment without law.

Class 7: Summary, evaluation.

If a student is absent three times in a row I am obliged to inform the Dean about it!

Requirements – how to pass?

Every student has to give a presentation concerning a chosen ECHR judgment in order to complete the course.

Presentations are prepared in pairs.

Presentation will be graded!

Presentation should take around 15 min.

There will be around 4 presentations per a class.

Content of presentation

1. name and number of the judgment

2. brief description of facts of the case (factual circumstances)

3. alleged violation of European Convention of Human Rights – which article and how was it allegedly breached?

4. ECHR’s legal findings – what did the Court establish, what were its arguments, was there a breach of the Convention?

5. why is this specific judgment important?

6. most important thesis of the judgment

Presentation cannot consist solely of quoted fragments of the judgment!

It is allowed to quote particular Court’s findings and the merits of the judgment, however it is obligatory to describe them orally in one’s own words.

PowerPoint presentation needs to be sent to lecturer via email at least one day before classes, prior to 8 PM!
