PRIVATE INTERNATIONAL LAW SYLLABUS

The purpose of the course: an introduction to general principles of choice of law process, an overview of main European and international instruments (so called the Hague conventions, UN conventions) that provide rules governing jurisdiction, applicable law and recognition and enforcement of judicial and extra-judicial decisions in civil and commercial cases.

Lecturer: dr Agata Jaroszek

The course is taught through formal lectures and group tutorials (classes).

Students will be given homework assignments (reading texts, cases)

Exam: written form 2 questions and one case to solve

Group tutorials: discussions based on reading materials, case analysis, oral presentations are welcome!

Attendance forms an important criterion to pass a course.

Students have an access to a set of relevant texts for reading at home.

Some course books are recommended; they can be accessible at the Faculty’s library.

Course book: There is not a general course book in English. In the chart below there are some books available at the Faculty’s Library.

Students will be working with reading materials and cases provided by the lecturer.

Polish speaking students are recommended to get familiar with the following course books (latest editions since 2012)

Commentaries to the Polish Private International Act of 2011 as well as the Polish case law and more articles in Polish can be also accessed at the following online databases:

1. Introduction to the basic concepts of the Private International Law.

2. Cross-border (foreign, international) elements.

3. Historical background. Unilateral and bilateral conflict of laws rules.

4. Public international law vs private international law

5. International conventions, bilateral international agreements, national codifications – different ways of regulation of conflict of laws issues.

6. General principles of private international law: public policy, renvoi, overriding mandatory rules, definitions, interpretation methods, application of public law.

8. Freedom of establishment – nationality, place of habitual residence.

9. EC LAW AND PRIVATE INTERNATIONAL LAW
