została zawarta umowa następującej treści:

§ 1

Przedmiotem umowy jest określenie warunków odpłatności za usługi edukacyjne świadczone w ramach Programu Międzynarodowego przez Uniwersytet Medyczny w Lublinie w związku z art. 160 a ustawy z dnia 27 lipca 2005 roku – Prawo o szkolnictwie wyższym (t. j. Dz.U. 2017, poz.

2183 z późn. zm.) zwanej dalej „ustawą”.

§ 2

1. Student oświadcza, że będzie ponosił koszty kształcenia na kierunku lekarskim / lekarsko- dentystycznym na które składają się:

hereinafter referred to as “the University”, and duly represented by

Vice-Dean of Second Faculty of Medicine authorized by Professor Wojciech Załuska M.D., Ph.D. – Dean of the II Faculty of Medicine with the English Division duly authorized to make declarations of will on behalf of the University

WHEREAS:

Article 1

This Agreement lays down terms and conditions of financing studies at the International Program at the Medical University of Lublin in compliance with the provisions of Article 160 a of the Act of 27 July 2005 on Higher Education (Journal of Laws 2017, item 2183 as amended), hereinafter referred to as “the Act”

Article 2

1.The Student declares that he/she shall bear the costs of tuition for medical / DDS studies comprising:

a)basic charge – tuition fee,

a) opłata podstawowa – czesne,

b) inne opłaty związane z tokiem studiów.

2. Opłaty na rzecz Uniwersytetu student będzie uiszczał na wskazane rachunki bankowe.

§ 3

Uniwersytet oświadcza, że spełnia następujące wymagania:

1) warunki kadrowe, lokalowe oraz posiada niezbędne wyposażenie do prowadzenia kształcenia na kierunku lekarskim oraz lekarsko-dentystycznym;

ponadto, zobowiązuje się je spełniać do końca planowanego okresu studiów, 2) wymagania wynikające z obowiązujących w Polsce standardów nauczania, a w tym warunki związane z łączną liczbą godzin zajęć prowadzonych przez uprawnione osoby.

§ 4

1. Uniwersytet oświadcza, że:

1) organizację i tok studiów określa regulamin studiów Uniwersytetu, a szczegółowe warunki studiowania w kolejnych semestrach, w tym program studiów, będą podawane do wiadomości Studenta za pośrednictwem strony internetowej www.umlub.pl,

2) stosowane będą następujące zasady i tryb organizacji praktyk zawodowych:

Uniwersytet zapewnia możliwość odbycia praktyk zawodowych we wskazanych przez siebie jednostkach organizacyjnych.

Student może ubiegać się o odbycie nieodpłatnych praktyk zawodowych w wybranej przez siebie jednostce organizacyjnej, jednak w takim przypadku student jest zobowiązany z minimum miesięcznym wyprzedzeniem złożyć podanie do Dziekanatu Wydziału i uzyskać stosowną pisemną zgodę Dziekana,

3) podjęte przez Studenta studia kończą się uzyskaniem tytułu zawodowego

„lekarza” / „lekarza dentysty”, do nadawania którego Uniwersytet ma uprawnienia.

b)other study course -related charges.

2. The student will settle the fees for the University on given bank accounts.

Article 3

The University declares that it meets the following requirements:

1. academic staff, educational facilities, relevant equipment required to study medicine and DDS; furthermore, the University undertakes to meet said requirements until the end of the scheduled study course,

2. the requirements resulting from teaching standards binding in Poland, including the conditions for the total number of hours of courses conducted by authorized persons.

Article 4

1. The University further declares that:

1) The organization and course of studies are specified in the Rules and Regulations of the University, and details concerning studying in subsequent semesters, including curriculum, shall be available to the Student on-line at www.umlub.pl;

2) The following principles and manner of organizing practical training courses shall apply: The University offers practical training courses in organizational units indicated by the University. The Student may apply for unpaid practical training courses in an organizational unit he/she chooses, subject to the submission and written approval of the application by the Dean at least a month prior to their commencement;

3) Upon the completion of the study course, the Student obtains the professional title of MD (“lekarz”) / DDS (“lekarz dentysta”) conferred upon him/her by the University duly authorized to do so.

2. Student oświadcza, że znany jest mu Statut Uniwersytetu oraz Regulamin Studiów obowiązujący na Uniwersytecie, w tym Rozdział III Prawa i obowiązki studenta, których treść znajduje się na stronie internetowej Uniwersytetu - www.umlub.pl

3. Student obowiązany jest do uiszczania opłat oraz regularnego monitorowania stanu swoich zobowiązań względem Uniwersytetu.

4. Student ma obowiązek powiadomić Uniwersytet o fakcie podjęcia lub kontynuacji nauki w innej uczelni w czasie obowiązywania umowy.

5. Student ma obowiązek posiadania polisy ubezpieczenia zdrowotnego, Europejskiej Karty Ubezpieczenia Zdrowotnego, potwierdzenia przystąpienia do ubezpieczenia w Narodowym Funduszu Zdrowia lub potwierdzenia pokrycia przez ubezpieczyciela kosztów leczenia na terytorium Rzeczypospolitej Polskiej.

Dokument potwierdzający ubezpieczenie powinien obejmować okres danego roku akademickiego, w którym student odbywa kształcenie.

§ 5

1.Wysokość opłat, o których mowa w §2 ust. 1 punkt a reguluje Załącznik nr 1 do niniejszej umowy.

2. Wysokość opłat, o których mowa w §2 ust. 1 punkt b określona jest w Zarządzeniu Rektora Uniwersytetu Medycznego w Lublinie w sprawie opłat związanych z odbywaniem studiów oraz opłat za usługi edukacyjne świadczone przez UM w Lublinie w ramach Programu Międzynarodowego zwanym dalej Zarządzeniem Rektora umieszczonym na www.umlub.pl

3. Zasady wnoszenia opłat, o których mowa w §2 ust. 1 określone są w Zarządzeniu Rektora.

4. Od nieterminowej zapłaty opłat wymienionych w §2 ust. 1 punkt a i b Uniwersytet nalicza odsetki ustawowe za opóźnienie.

§ 6

2. The Student declares that he/she has read and understood the Statute of the University and the Rules and Regulations of the University, including Chapter III – Students’ Rights and Obligations, available at www.umlub.pl 3. The student is obliged to pay fees and to

regularly monitor the status of his/her obligations toward University.

4. The student must notify University about the fact of taking or continuing studies at another university at the time of the contract.

5. Student is obligated to be a holder of health insurance, European Health Insurance Card, insurance in the Polish National Health Fund (NFZ) or a proof of bearing the treatment costs by the insurer on the territory of the Republic of Poland. A document confirming insurance should encompass a period of a given academic year, during which a student is enrolled.

Article 5

1. The principles of paying tuition fees referred to in article 2 point 1 letter a are specified in Appendix No. 1.

2. The amount of fees referred to in article 2 point 1 letter b are specified in Resolution by the Rector of Medical University of Lublin concerning the fees connected with the study process and fees for educational services provided by the Medical University of Lublin under International Program referred to as Resolution issued by the Rector, the said regulation is available at www.umlub.pl

3. The principles of paying tuition fees referred to in article 2 point 1 are specified in Resolution issued by the Rector

4. The University charges statutory late fees from belated payments

enumerated in article 2 par. 1 point a and b.

Article 6

Subject to the provisions set out below, the tuition fees are non-refundable:

Opłaty za naukę nie podlegają zwrotowi z zastrzeżeniem poniższych punktów:

1. Opłaty za naukę podlegają zwrotowi za okres nie pobierania nauki, jeżeli student otrzymał urlop lub zrezygnował z nauki z powodów zdrowotnych potwierdzonych zaświadczeniem lekarskim albo ważnych przyczyn losowych.

2. Opłaty za naukę podlegają zwrotowi w całości lub części na zasadach określonych w Zarządzeniu Rektora.

3. Zwrotu opłat dokonuje się na pisemny wniosek studenta kierowany do Dziekana.

§ 7

1. Zmiana wysokości opłat jest dopuszczalna w przypadkach:

1) wzrostu kosztów w zakresie niezbędnym do prowadzenia studiów na kierunku lekarskim / lekarsko- dentystycznym, z uwzględnieniem kosztów przygotowania i wdrażania strategii rozwoju uczelni, w szczególności rozwoju kadr naukowych i infrastruktury dydaktyczno-naukowej, w tym amortyzacji i remontów, nie więcej jednak niż o 5% kosztów czesnego dla całego toku kształcenia

2) zmniejszenia średniego kursu EUR ogłaszanego przez NBP w stosunku do złotego na dzień 28 lutego każdego roku akademickiego, o co najmniej 5%

w odniesieniu do kursu średniego EUR obowiązującego w dniu zawarcia umowy

3) wzrostu wskaźnika cen towarów i usług konsumpcyjnych ogłoszonego Komunikatem Prezesa Głównego Urzędu Statystycznego w Dzienniku Urzędowym „Monitor Polski” o co najmniej 5%. Procentowa zmiana czesnego nie powinna przekraczać wartości wzrostu wskaźnika.

2. O zmianie w wysokości czesnego student będzie powiadamiany z 3-miesięcznym

1. Tuition fees can be refunded for the period during which the Student did not participate in the study course if such approved leave of absence was due to the leave granted or cancellation of his/her study course due to health reason confirmed by medical certificate or due to unfavorable circumstances beyond his/ her control.

2. Tuition fees can be refunded in full or partially based on principles described in Resolution issued by the Rector.

3. Tuition fees shall be refunded at the Student’s written and documented application forwarded to the Dean.

Article 7

1. A change in the amount of tuition fees is admissible in the following cases:

1) increase in costs to the extent necessary to carry out studies at the Faculty of Medicine / DDS, including the costs of preparing and implementing the development strategy of the university, in particular the development of academic staff and teaching and research infrastructure, including depreciation and repairs, but not more than 5% of the cost of tuition fees for the whole course of studies

2) reduction of the foreign exchange rate (EUR against PLN) as determined in compliance with the Regulation by the minister of Finance and announcement by the National Bank of Poland on February 28 of each academic year, of at least 5% in relation to the EUR average exchange rate prevailing at the date of the agreement with the student

3) increase in consumer price index at least 5% as determined in compliance with an announcement of President of Central Statistical Office published in “Dziennik Urzędowy Monitor Polski” [eng. Offical journal “Monitor Polski]. Percentage change of tuition fees should not exceed the value of the index.

2. The Student shall be notified about any changes in the amount of tuition fees three months in advance. Notification will be made by sending an e-mail to the e-mail address

wyprzedzeniem. Powiadomienie nastąpi poprzez wysłanie zawiadomienia na wskazany przez studenta adres e-mail i dodatkowo poprzez zamieszczenie informacji na stronie internetowej Uniwersytetu.

3. Student może odstąpić od umowy w terminie 2 miesięcy od daty otrzymania zawiadomienia o zmianie wysokości opłat. W razie nie skorzystania z prawa do odstąpienia, student zobowiązany jest zawrzeć aneks do umowy.

§ 8

Uniwersytet - spełniając w procesie prowadzenia studiów wymagania wynikające z przepisów o ochronie danych osobowych - nakłada na Studenta obowiązek pisemnego jej powiadamiania o zmianie jego danych osobowych zawartych w niniejszej Umowie.

Skutki zaniechania wykonania tego obowiązku obciążać będą Studenta.

§ 9

1. Umowa zawarta została na czas określony do dnia planowego zakończenia studiów określonego regulaminem studiów.

2. Umowa zostanie przedłużona o czas przedłużenia studiów na warunkach określonych w regulaminie studiów.

3. Umowa wygasa w wypadku wcześniejszego skreślenia Studenta z listy studentów.

4. W wypadku, o którym mowa w ust. 2 i 3 Studenta obciążają opłaty należne do dnia wygaśnięcia umowy.

§ 10

1. Zmiana postanowień Umowy wymaga formy pisemnej pod rygorem nieważności.

2. W sprawach nie uregulowanych niniejszą umową mają zastosowanie odpowiednie przepisy ustawy i wydanych na jej podstawie przepisów wykonawczych, Statutu Uniwersytetu, Regulaminu Studiów i innych uchwał Senatu i zarządzeń Rektora Uniwersytetu oraz Kodeksu Cywilnego.

3. The Student can withdraw from the

Agreement within 2 months from the receipt of notification on the changes in the fees amount. In case the student does not exercise the right to withdraw, he/she is obliged to conclude an annex to the Agreement.

Article 8

In meeting the requirements laid down in the provisions on personal data protection, the University obliges the Student to notify the University in writing about any changes made to the personal data as specified in this Agreement. The consequences of the failure to fulfil this obligation shall be borne by the Student.

Article 9

1. This Agreement is concluded for a specified period until the scheduled study completion date as specified in the Rules and Regulations.

2. The Agreement shall be prolonged by the time of extension of studies on the terms and conditions specified in the Rules and Regulations.

3. The Agreement is terminated if the Student is removed from the list of students.

4. In the cases specified in paragraphs 2, and 3, the Student shall be held liable to pay the fees until the date of termination of the Agreement.

Article 10

1. Any changes made to this Agreement must be made in writing otherwise shall be null and void .

2. In matters that are not regulated by this Agreement relevant provisions of the statutory act and executory provisions there to, the Statute of the University, the Rules and Regulations of the University, the resolutions of the Senate and Regulations by the University Rector and the Polish Civil Code shall apply.

3. Any disputes arising out of or in connection with this Agreement shall be

Umowy, Strony poddają

rozstrzygnięciu sądów powszechnych w Polsce właściwych dla siedziby Uniwersytetu.

4. Umowa została sporządzona w dwóch jednobrzmiących egzemplarzach, po jednym dla każdej ze Stron.
