Among the private documents № 142 (23 A . D . ) is a loan, № 144 (early

3rd cent. A . D . ) an antichretic loan on houses where the right of habitatio is

granted in place of interest. T h e papyrus shows that the άντίχρησκ, at least

that on ίνόικησ« is considered as a real right. T h a t is proved by the fact

that the papyrus determinates the antichretic loan of this kind as то όφάλΐΐν

ίφ' ΐνοικήσιι and that the άντίχρησις is subject to παμάθισις in the βιβλιοθήκη

ί-γκτησίων to the effect that the debtor is not permitted to alienate his

apartments until he pays back the loan (cf. Taubenschlag, Law 2 2 0 ) .

T h i s new volume contains a series of papyri of private and public

character.

No. 1223 (131 A . D . ) and 1224 ( 1 5 6 / 7 A . D . ) registers of Ιφηβοι in

Alexandria, are important for our understanding of άγραφος and ίγγραφος

γάμος. T h e former papyrus points out (1. 10) : φάμινοι iromvm iavroU

ττρότιpov μ(ν άγράφως, νυνιι S( καθ' όμολογίαν, the latter (1. 9 ) φάμινοι σννί'ι [ rat t ]

-avroU аурафшч. (cf. Taubenschlag, Law, p. 8 7 ) . N o . 1258 (third cent.

A . D . ) refers to a will and testament, in which a Roman woman under age

is appointed heiress and a Roman citizen tutor impuberis. T h e testator

imposes on the heiress the obligation to maintain her mother for lifetime.

N o . 1263 (second cent. A . D . ) , a fragmentary testament, was already

published by F. Perosa, Stud. ital. di Fil. Class. X I I ( 1 9 3 5 ) , p. 98-102.

N o . 1238 (244 A . D . ) refers to a cancellation of an υποθήκη in

conse-quence of the repayment of the debt. Simultaneously the creditor declares

the ίνίχνρασία which had already taken place, null and void. N o . 1237

( 1 6 2 A . D . ) refers to execution of executional documents which advanced

through ίνίχνρασία and καταγραφή to ipßaSeia and its completion by ίκχωρησιι

( c f . Taubenschlag, Law, 4 0 9 / 1 0 ) .

N o . 1235 (1st cent. A . D . ) refers to reports of κολλυβιστική τράπίζα to

βιβλιοθήκη {γκτήσεων and was already published by M . Norsa, Papiri greci

delle coll. ital. fasc. 2. tav. XIV. N o . 1255 ( t h i r d cent. A . D . ) concerns

a report to the βιβλιοθήκη on property.

N o . 1228 ( 1 8 8 A . D . ) is a sale of a half of a slave. T h e buyer is the

co-proprietor of the other half and acts through a representative. T h e

papyrus points out that the representative paid the price with the money

of his mandator who according to a principle recognized by the Greek law,

acquired title (cf. Taubenschlag, Law, p. 2 4 5 ) . I t is noteworthy that the

p a r t of a slave was encumbered by an υποθήκη which the seller paid off.

I t may be also mentioned that the slave was brought up by an ίπιλινθίρα

evidently at the expense of both the co-proprietors. In P S I . 1254 ( 2 3 7

A . D . ) , an application for άνάκρισιτ of a Macedonian slave, a copy of the

contract concerning the sale of the slave is enclosed. In this contract we

read that M a r c u s Aurelius Didymos (1. 17) ιπρίατο (the slave) παρά

Φλαβίον ΤΙρίίσκον πίστα και βίβαιωσα Αιμιλίου Εύτυχοΰΐ. ( O n fidejussor in

Roman sales cf. Mitteis, Grundz. 2 6 9 ) . N o . 1239 ( 4 3 0 A . D . ) a sale of

a third part of a house was already published by Camelli; Aegyptus X V ,

242ff. N o . 1249 ( 2 6 5 A . D . ) , 1250 ( 2 6 5 A . D . ) , 1251 ( 2 5 2 A . D . ) , 1252

(third cent. A . D . ) are sales on delivery (cf. Taubenschlag, Law, p. 2 5 2 / 3 ) .

N o . 1244 ( 2 0 8 / 9 A . D . ) of people for κατασπορά. N o . 1243 ( 2 0 8 A . D . ) is an

application for discharging of a liturgy and 12^5 (207 A . D . ) deals with

the same problems. No. 1240 (222 A . D . ) is an application for granting the

status of

concerning the heirs of a πράκτωρ was already published by G . Pascucci, Ann.

d. R. Sc. Norm. Sup. di Pisa, 1934, p. 27ff. N o . 1265 ( 4 2 6 or 441 A . D . )

deals with the election of a « φ α λ α ι ω π ^ of a corporation, and was already

published in the same Ann. 1937 p. 1-7 by M . Norsa.

T h e Greek papyri catalogued in this volume were presented to the University of Aberdeen by James Andrew Sandilands Grant, an alumnus of the University. T h e bulk of them comes from Dime, and there are only a few from other places in the Fayum. T h e Ostraca were presented to the University by M r . J. G . Tait and come from Elephantine.

№ 1-6 are theological fragments, 7-14 literary and near-literary texts, № 15-72 non-literary-texts, № 73-103 documentary ostraca, Nu 104-97

summary publications.

A m o n g the non-literary texts, № 15-50 are official documents. № 15 (3rd cent. A . D . ) is an edict of Severus and Caracalla relating to ζωγράφοι. It is worth recalling that all known instances of a tax on ζωγράφοι, what-soever its name (cf. Wallace, Taxation 2 2 2 / 3 ) are dated about 200 A . D .

(cf. Reil, Beiträge zur Kenntnis des Gewerbes im hell. Aegypten, 1 7 0 ) . It is not implausible that some questions concerned with the administration of the tax formed the content of the present edict. № 16 (134 A . D . ) an official circular letter shows that at least the most important members of the Egyptian priesthood were in principle immune from χωρικοί λΐΐτονργίαι in the first and early second centuries (cf. Oertel, Liturgie 3 8 2 / 3 ; Wilcken,

Grundzüge 3 4 0 ) . № 17 (2nd cent. A . D . ) is a report of judicial proceed-ings probably of an actio tutelae. № 19 ( 2 / 3 r d cent. A . D . ) resembles closely P. Meyer, Jur. Pap. № 48 and refers to the execution of executional documents. № 149 (Hadrian's period) concerns the law-suit of Drusilla. № 130 is a Latin legal text. № 2 0 (2nd cent. A . D . ) is part of a declaration made by seventy-two persons who may be persons specially appointed to attend to the καταγωγή τον σίτου (cf. B G U . 1022) or members of a guild of donkey or camel drivers (cf. Oertel, Liturgie 120). They undertake to transport ( ? ) corn ( ? ) to harbours appointed, to attend to the loading of it on board ship, to obey the instructions ( ? ) of persons appointed by lot in each village, to supply the salaries of clerks described as ανθίνται and to pay a fine for contravention of their engagements. № 153 ( 1 6 2 / 3 A . D . ) is an απογραφή of unwater land. № 27 ( l / 2 n d cent. A . D . ) :з

a tax-register probably for δόσκ. № 45 (141 A . D . ) is an application for lease of a monopoly. T h e phraseology of the papyrus bears a close re-semblance to that of P. Amh. 92 = W . Chr. 311.

№ 51 (2nd cent. A . D . ) contains references to transactions of the àpXi(pevs Αιγύπτου and the idiologos. T h e y may form part of. a petition or

of a record of proceedings (υπομνηματισμοί). Line 11 ίδί]ων λόγων και

άρχχρίων supplies additional confirmation for the theory that the office of ίδιοϊ λόγος and άρχιερευς remained separate until the end of the second century. № 174 ( 1 5 4 / 9 A . D . ) is the end of a petition addressed to the prefect Marcus Sempronius Liberalis. № 175 (139 A . D . ) is a petition pre-sumably to the epistrategos Julius Petronianus, № 176 ( 2 0 2 A . D . ) to the

βασιλικός γραμματεύς concerning a wrongful appointment to the liturgy of

πρεσβυτερία κώμης. № 53 ( 1 0 / 1 1 A . D . ) is a contract for a division of property, № 55 (reign of Hadrian) sale of an ass where the guarantee of title against eviction is missing, № 180 (4th cent. A . D . ) a mutilated contract of παραθήκη, № 56 (176 A . D . ) an antichresis, independent from the pledge on free persons in the shape of a loan (cf. Taubenschlag, Law 218 note 177), № 181 (Claud. N e r o ) a mutilated application for lease of an oil-factory (cf. also № 182, 183), № 57 (2nd cent. A . D . ) an application for sublease of palm and olive-trees «growing on public land, N ° 58 (3rd cent. A . D . ) locatio-conductio operarum with an artist, № 59 ( 4 / 5 t h cent. A . D . ) locatio-conductio operis with a teacher, № 61 ( 4 8 / 9 A . D . ) a Latin receipt, № 63-65 are private receipts for rents cf. also № 170.

If the restoration in № 149 ( 2 / 3 r d cent. A . D . ) is right, this supplies the first mention on papyrus of the praefectus montis Berenicidis, the evi-dence for which official was previously entirely epigraphical (cf. Lesquier,

L'armée romaine ď Égypte 153). № 187 (2nd cent. A . D . ) is a fragment of the beginning of a letter. T h e writer and addressee are the same as those in B G U . 846, the famous "prodigal son" letter and this fragment is in the same hand (cf. Deissman, Light from the Ancient East, 4th ed. 156). G .
