ON THE TRANSFER OF COPYRIGHT TO SCIENTIFIC WORK

Concluded on ……….. between the University of Warsaw, based in Warsaw, Krakowskie Przedmieście 26/28, hereinafter referred to as the University, represented by :

the Dean of the Faculty of Management of the University of Warsaw, Professor Alojzy Z. Nowak, and NAME and SURNAME of THE AUTHOR

residing in COUTRY, CITY, POSTAL CODE.

at NAME and NUMBER OF THE STREET hereinafter referred to as the Author.

§ 1

1. The University orders, and the Author submits manuscript TITLE OF THE ARTICLE………

hereinafter referred to as ‘the Article’ which shall be published by the Scientific Publishers of the Faculty of Management of the University of Warsaw in Journal of Marketing and Consumer Behaviour in Emerging Markets, No …/20... hereinafter referred to as the Journal and upon the reception and acceptance of the Article the Author shall transfer copyright on the University, including the right to dispose of the Article in the following forms and areas:

1) the right to publish, republish, transmit, sell, distribute and otherwise use the Article and any supplemental tables, illustrations or other information submitted therewith that are intended for publication as part of the Article in electronic and print editions of the Journal, in all forms and media whether now known or hereafter developed, throughout the world, in all languages, for the full term of copyright, effective when and if the article is accepted for publication.

2) the right to provide the Article in electronic and online forms and systems.

2. With respect to supplemental data which are to be accessible through a link in the Article, the Author hereby grants a non-exclusive license for such linking.

3. If the Author has agreed with University of Warsaw to make available supplemental data on a site or through a service of University of Warsaw, the Author hereby grants a non-exclusive license for such publication, posting and making available, and further permit indexing and archiving.

4. The transfer of copyright on the University is royalty free.

§2

1. The Author declares that the Article submitted to the journal for review is original, has been written by the stated authors and has not been published elsewhere.

2. The Author declares that the Article is not currently being considered for publication by any other journal and will not be submitted for such review while under review by this journal.

3. The Author declares that the Article contains no libellous or other unlawful statements and does not contain any materials that violate any personal or proprietary rights of any other person or entity.

4. The Author declares to have obtained written permission from copyright owners for any excerpts from copyrighted works that are included and have credited the sources in my article.

5. The Author declares that if the Article was prepared jointly with other authors hereinafter referred to as co-author(s), these co-author(s) have been informed of the terms of this Agreement and that these co- author(s) have authorized the Author to sign this Agreement on their behalf as their agent.

§3

The Author retains or is hereby granted without the need to obtain further permission the retained rights.

The retained rights include:

1) the right to make print or electric copies of the Article published in the Journal for their own personal use, including for their own classroom teaching use;

2) the right to make copies and distribute copies, including via e-mail, of the Article published in the Journal to research colleagues, for personal use by such colleagues;

3) the right to present the Article published in the Journal at a meeting or conference and to distribute copies of such paper or article to the delegates attending the meeting;

4) patent and trademark rights and rights to any process or procedure described in the Article published in the Journal;

5) the right to include the Article published in the Journal, with full acknowledgement of its original publication in the Journal , in full or in part, in a thesis or dissertation;

6) the right to use the Article published in the Journal or any part thereof in a printed compilation of works of the author, such as collected writings or lecture notes subsequent to publication of the Article published in the Journal;

7) the right to prepare other derivative works, to extend the journal article into book-length form, or to otherwise re-use portions or excerpts in other works, with full acknowledgement of its original publication in the Journal.

§4

1. A Statement, which is an amendment to this Agreement, shall be an integral part of this agreement.

2. No revisions, additional terms and addenda to this Agreement can be accepted without the University’s of Warsaw express written consent.

§5

1. Reception and acceptance of the work by the University shall be in the University seat.

2. The University authorize Dr Katarzyna Dziewanowska, Editor-in-chief of Journal of Marketing and Consumer Behaviour in Emerging Markets to receive and accept the Article.

3. Reception of the work is deemed executed upon the confirmation of the completion of the work by the person designated in part 2 by email sent to the Author.

§6

1. The University reserve the right to reject the Article or its part, if whatever deficiencies (formal or essential) are identified, and in particular if the Article:

1) fails to meet the criteria of a work in the sense of copyright, 2) fails to meet the accepted University formal standards,

3) fails to explain the subject matter enough, includes simplifications or falsehood, 4) displays disqualifying editorial defects.

2. In the situation referred to in part 1, the University:

1) prolong the time limit for the delivery of the Article, 2) accept the work, in agreement with the Author, 3) withdraw from the contract

3. If the time limit as designated in point 2 subpoint 1 expires and the Article still fails to meet the requirements, the University may withdraw from the contract.

§7

Third party liabilities resulting from the execution of this Agreement shall be the responsibility of the University, unless the Author is involved in business operation.

§8

All matters not covered under this agreement shall be subject to laws on copyright and related laws.

§9

Any disputes under the present agreement shall be settled by the courts due for the University.

§10

All changes to the agreement shall be in writing, otherwise such changes shall be deemed null and void.

§11

The agreement has been concluded under article 4 point 8 of the Public Procurement Law.

§12

The present agreement has been executed in two identical copies, one for each of the parties.
