1.4. Completing the family reunification application form

FAMILY REUNIFICATION APPLICATION FORM:

ˍ Should be submitted on a special form in 2 copies – you should find it in the voivodeship office or on its website,13

ˍ The application form should be completed in Polish, legibly, in block letters and provide only true information, consistent with the facts. You should not withhold any information as this may result in a decision refusing family reuni-fication. If you do not speak Polish, it is recommended that you contact one of the non-governmental organizations that provide support to foreigners. These organizations are listed at the end of this manual in Appendix II ico.circlearrowright p. 131, ˍ The application form must be completed for each family member separately,

for example separately for the wife and for each child.

IMPORTANT!

Your spouse and the child, if 13 or older, 14 must complete Part D of the family reunification application form. There is a signature specimen box.

This does not apply to a situation where family members reside outside Poland, when the child is under the age of 13, or when the person cannot sign it on their own due to their disability. In this case, the box should be left blank.

If your family members are not in Poland, fingerprints will not be taken from you in their stead. They will be collected from family members upon their arrival in Poland, at the time of submitting the application for a residence card.15

Tips

ˍ Before completing the application for family reunification, read carefully the instructions on the application form!

ˍ The family reunification application form must be completed in full. This means that if you are unable to provide certain information, for example, the child’s previous surname because they did not have one, you should enter

“NOT APPLICABLE” („NIE DOTYCZY”) in the relevant field in the application.

ˍ Personal data should be entered in accordance with the spelling contained in the travel document.

ˍ If in the past you had other personal data, for example, first name, surname, it is necessary to enter it in the form.

ˍ If your family members do not have a PESEL number, enter „NONE” („BRAK”) in the field for the PESEL number.

ˍ Provide your phone number and e-mail address in the form – it will make it easier for officers to contact you. They may call you or write e-mails – only in addition to and beyond formal correspondence. If you do not speak Polish or if the officer does not know your language, contact one of the non-governmental organizations that support foreigners in order to fa-cilitate mutual contact. These organizations are listed at the end of the manual in Appendix II ico.circlearrowright p. 131.

ˍ Provide also your residence address in the form. The voivodeship office will send you letters which you should be able to receive and reply to.

IMPORTANT!

You should always notify the office when you change your address or telephone number. It is your obligation, and it will also allow you to avoid many complications such as, for example, sending a letter by the office to your previous address. Information about the change of ad-dress should be sent to the office by registered letter!

If you leave Poland, you must provide the office with an address for service in Poland or appoint a representative (pełnomocnik), i.e. a person who will be authorized to take any action on your behalf. In principle, any adult can be a representative16 and an authorization document (po-wer of attorney) should be prepared in writing, in Polish or in a language that you understand. It is the representative who should present such a document to you for signature. Appointment of a representative is subject to an administrative fee of PLN 17.17 You will find the account number on the website of the relevant voivodeship office (see Appen-dix I ico.circlearrowright p. 126.18

IMPORTANT!

The representative will receive letters regarding your case. This means that you will no longer receive any letters directly from the voivodeship office.

Information on criminal records is very important! Include information about pending criminal proceedings and any convictions. If you are not sure if there have been any convictions in your case, then you should consult the National Criminal Register for information about your crimi-nal record. This can be done in two ways:

˂ Traditionally: fill in a special form19 in Polish and pay a court fee of PLN 30. The fee can be paid, among others, by bank transfer to the account number of the Ministry of Justice20 or in cash at the cash desk of the Ministry of Justice or a court,

˂ Electronically via the e-platform of the Ministry of Justice.21 The court fee is PLN 20 and is payable when submitting an inquiry on the e-platform.

The received response to the submitted question should be attached to your files.

IMPORTANT!

The application for family reunification should be signed legibly in de-signated places.
