CONTENTS

Bożena Sułkowska – Peer Review at the Supreme Chamber of Control .... 3 Recognizing the need to constantly improve the institution, the SCC lea-dership decided to invite external auditors as evaluators. The National Audit Offi ce of Denmark was chosen for carrying out the Peer Review at the SCC because of the DNAO’s parallel organizational structure, culture closeness, and many-year tradition of good cooperation. Findings, opinions and experts’

recommendations are contained in the Peer Review Report.

Marcin Bik – Self-Assessment of Administrative Decisions under Appeals Procedure ... 30 The core instrument designed to protect the rights of an individual in the course of administrative proceedings is the appeals procedure. Whenever an administrative decision is appealed against, the respective fi rst instance organ may be offered an opportunity to review the regularity of their own fi ndings made at the stage of case adjudication, without involving their supreme level organ of appeals. Decisions allowing to pursue this exceptional path, i.e., granting self-assessment authorizations to institutions, must be justifi ed in terms of the pursuit of important goals.

Wanda Karpińska-Mizielińska, Tadeusz Smuga – Barriers to

Implementing the Strategy of Absorption of 2007–2013 EU Structural Funds’ Resources ... 47 One barrier to implementing the provisions contained in the „National Strategic Framework [Program] for 2007–2013” lies in insuffi cient legi-timization of the strategy by the public in general, and participants in the implementation system at the Regions’ level in particular. Despite the very broad scope of public consultations provided for in the Strategy, the relevant assumptions become known primarily to the institutions which are to be

directly involved in their implementation; only to a limited degree do they reach fi nal benefi ciaries, and remain practically unknown to public opinion.

Stanisław Laskowski – Rules for Setting Up and Functioning of Special Economic Zones ... 72 The 12-year period of Special Economic Zones’ functioning has greatly contributed to the economic development of those Polish regions in which the zones were once established. The value of 1995-2006 investment by entrepreneurs exceeded 31 bln Polish zloties with 850 valid licenses issued for carrying out economic activities, and over 100 thousand new jobs created in the zones.

Paweł Wieczorek – EU Activities Towards Reducing Greenhouse Gases’ Emissions ... 95 Growing levels of greenhouse gases polluting the atmosphere cause a gradual increase in average Earth temperatures, which in turn generates the threat of vast and irreversible disturbances occurring in the global ecosystem.

Hence the necessity of taking action towards stopping the degradation of the natural environment. From international initiatives taken to this end, 1997 Kioto Protocol, signed as a supplement to the so-called 1992 Climatic Convention, is most frequently quoted. The key part of this agreement contains signatory states’ obligation to reduce the amounts of greenhouse gases emitted to the atmosphere between 2008 and 2012.

Piotr Solarz – Corruption, Clientism, Political Capital as Core Notions Brought Up in the Debate on Public Life Openness in Poland ... 114 An open debate around the defi nitions of such notions as corruption, clientism, or political capital, continues in the circles of Polish research workers representing many branches of study. The debate shows that the above notions are understood and interpreted quite differently. Yet, it is worth noticing that exchanging opinions on their varying interpretations leads to discovering similarities, and thus creating grounds for developing common positions vis a vis the notions in question.

THE SETTLEMENTS OF SOME CONTROLS

Sławomir Czarnow – The Right of Access to Public Information in Poland – Suggested Changes ... 119 According to the Constitution and the Act on Access to Public Information, the Polish citizen has the right to obtain information on activities pursued by public organs of power, economic and professional self-Governments, persons performing public functions, as well as other persons and structu-ral units to the extent to which they are involved in public task performance and communal or State Treasury property management. Irregularities in the application of the principle of openness, as well as in the functioning of the

„Public Information Bulletin”, are testifi ed by fi ndings from the three audits carried out by the SCC.

Dariusz Zielecki – How boroughs [gminas] handle alimony debtors? ... 136 Liquidation of the Alimony Fund, and replacing it with a system of advance payments by the boroughs, has failed to improve the situation. In general, the system is effective in providing advance payments to the entitled parties, but remains ineffective in recovering outstanding alimony payment amounts from debtors.
