der Gemeinde Krzemienica.

Die vorliegenden Studien stellen ergänzende Beiträge zu der eben erscheinenden Edition des
„Schöffenbuches der Gemeinde Krzemienica aus den Jahren 1451—1482“d a r1) und sollen in ihrem I. Teile einerseits vervollständigende Nachträge zur handschriftlichen Überlieferung der deutschsprachlichen schöffengerichtlichen Entscheidungen von Krzemie
nica, andererseits Vervollständigung des bereits der Ausgabe beigegebenen Familiennamenregisters bis zum Jahre 1600 nebst einem kurzen familien
geschichtlichen Exkurs beibringen, im II. Teile dann die Sprache des Schöffenbuches in ihren allgemeinsten Eigentümlichkeiten charakteri
sieren. Allgemeine Beobachtungen, die ich seinerzeit bei der Texther
stellung für die Edition bereits machen konnte, habe ich schon dort einleitend vermerkt und kann mich hier'dam it begnügen, sie nur der Übersicht wegen auszugsweise und in gedrängter Form wiederzugeben, im übrigen auf die Einleitung der Ausgabe hinzuweisen.
Das bisher als ältestes Schöffenbuch der Gemeinde Krzemienica nachgewiesene Manuskript — 262 Seiten in Quartformat — umfaßt in 738 Einträgen die Jahre 1451—1482.- Der verschiedenartige Schrift
zeichencharakter sowie orthographische und phraseologische Eigentüm
lichkeiten, — letztere besonders in den Einleitungsformeln erscheinend — lassen eine Unterscheidung von 16 Schreiberhänden zu, deren ziemlich auffällige Differenziertheit jedoch einen einheitlichen Gesamteindruck des sprachlichen Charakters nirgends stört. Daß die Sprache als schlesi
sches Ostmitteldeutsch angesprochen werden kann, zeigen die wesentlich ostmitteldeutschen Eigentümlichkeiten des Vokal- und Konsonanten
standes einerseits und die grundsätzliche Durchführung des Diphton- gierungsprozesses der mhd. Laute I, ü, iu andererseits. "Diese Tatsache im einzelnen zu erweisen, ist Aufgabe und Ziel des weiter unten folgenden sprachgeschichtlichen Teiles unserer Untersuchung.
Abgesehen vom Inhalt — seine rechtshistorische Bedeutung charakte
risiert a. a. O. H. F. Schmid — und Sprache, ist es vor allem das große Namenmaterial, das einerseits durch sein Übergangsstadium von der Ein- zur Zweinamigkeit, m it immer zunehmender Tendenz zum Fest
werden der Doppelnamen, manche namengeschichtliche und andererseits

durch beigegebene Verwandtschaftsbeziehungen und Amtswürden auch familien- bzw. verfassungsgeschichtliche Einzelheiten erschließen läßt.
Hier ist es das Ziel der ergänzenden Beiträge zur Familien- und Namen
geschichte des Dorfes Krzemienica die in der erwähnten Einleitung zur Edition angegebenen Tatsachen auf eine breitere Basis zu stellen, und diese geschichtliche Weitung — zunächst bis zum Jahre 1600 — durch neu gewonnenes Material zu stützen.
M it der Trägerin dieser Materialien — der handschriftlichen Über
lieferung der Schöffensprüche n a c h dem Jahre 1482 — soll sich nun
mehr das zunächstfolgende Kapitel beschäftigen.
I. T e i l .
i . Z u r handschriftlichen Überlieferung.
Außer dem eingangs erwähnten Schöffenbuche der Gemeinde Krze
mienica verwahrt die Bibliothek der Akademie der Wissenschaften in Krakau unter den Signaturen 1840/11 und 1841/1 noch zwei weitere Foliohandschriften solcher schöffengerichtlicher Entscheidungen, im Um
fang von 464, bzw. 200 Seiten. Der ältere Band enthält Einträge aus den Jahren 1581—1622,2) die bis zum Jahre 1600 fast ausschließlich in deutscher Sprache abgefaßt sind (die auftretenden lateinischen Ein
träge sind meist Datums-, bzw. Eröffnungsvermerke, die drei polnischen Einträge fallen durch ihre Sonderstellung aus dem einheitlichen Gang.3) Von 1610—1612 überwiegt die polnische Sprache, die Jahre 1613 u. 1614 zeigen nur deutsche, 1615—1617 nur polnische Eintragungen, im Jahre 1618 überwiegt wiederum das Deutsche, 1618—1622 herrscht es aus
schließlich, um 1622 endgültig der polnischen Sprache zu weichen.
Der jüngere Band, aus den Jahren 1673—1717 weist hingegen nur mehr polnische Einträge auf.
Diese Tatsachen lassen uns erkennen, daß in Krzemienica vom Zeit
punkte des Beginnes der Kolonisation an der Wende des X I I I . Jhts.
bis zum Jahre 1610 — also durch drei Jahrhunderte — die deutsche Sprache als Amtssprache volle K ra ft und Geltung besaß. Erst m it diesem Jahre beginnt sich daneben eine polnische Amtssprache durch
zusetzen, um nach verhältnismäßig kurzem Kampfe, m it dem Jahre 1622 einen endgültigen Sieg zu erringen. Dieser Prozeß ist auch m it eine weitere Folge und naturnotwendige Konsequenz des ganzen Entwick
lungsganges der deütschrechtlichen Kolonisation des Mittelalters. „ Im

allgemeinen ist ihre Lebenskraft auf polnischem Boden im dörflichen Rechtskreise im 15. Jahrhundert erloschen: das kommt äußerlich in der Vermischung der deutschrechtlichen Terminologie m it derjenigen der dörflichen Organisationsformen bodenständig polnischen und — in Rot
rußland — ostslavischen Rechts, innerlich in dem Vordringen des polni
schen materiellen Rechts, zunächst in subsidiärer Geltung, in der Recht
sprechung der Dorfgerichtsbehörden zum Ausdruck. Die deutschrecht
liche bäuerliche Siedlung hat ihre Aufgabe erfüllt, die Vereinheitlichung der Wirtschaftsgrundlage und die Schaffung eines geschlossenen Bauern
standes.“ 4)
Leider bieten die uns überlieferten Handschriften keine kontinuier
liche Abfolge der schöffengerichtlichen Entscheidungen; vor allem klafft eine fast hundertjährige Lücke [1482—1581] zwischen dem ersten und zweiten Band. Einen kleinen Teil dieser Lücke aber doch ausfüllen zu können, verdanken w ir einem günstigen Zufall.
Die Bibliothek des Ossolineums in Lemberg besitzt unter ihren handschriftlichen Beständen unter Sign. I I 2092 einen dünnen Sammel- band
„S p o m in ki Łańcuckie 1622“ .5)Auf dem ersten B latt dieser Samm
lung berichtet ein gewisser Symon G(e)bauer, Tischtuchweber und Bürger von Łańcut, über den Tatareneinfall in das Gebiet von Krosno am 16. Juni 1622, erzählt, daß dieser erst bei Halicz durch die Kosaken einen Widerstand gefunden habe, schildert: das Morden, Rauben, Sengen und Brennen der wilden Horden und te ilt m it, daß diese Tataren auch zwei alte, doppelseitig beschriebene Bücher, die durch dreihundert Jahre in deutscher Sprache geschrieben worden waren, vernichtet hätten. Er habe die Überreste gesammelt und die Schäden, soweit als möglich, wieder gutgemacht. Daran schließt er den frommen Wunsch, daß Gott uns alle vor solcher Grausamkeit und Plage bewahren möge und einige allgemeine, an sich völlig unbedeutende Sentenzen. Datiert ist dieser Eintrag:

Die überlieferte Datumsangabe im Eintrag 8:

Außer diesen wenigen Blättern war — so weit w ir heute wenigstens feststellen können — alles Übrige der Schöffenaufzeichnungen zwischen den Jahren 1481 und 1580 wohl der Vernichtungswut der tatarischen Horden zum Opfer gefallen.
Ein günstigeres Schicksal war d m schon oben erwähnten 2. Bande (1581—1622) beschieden. Er blieb als Gesamtheit erhalten, nur stellen
weise gingen einzelne Blätter verloren, so beispielsweise gleich der Anfang.
So wie ihn uns das Manuskript der Krakauer Akademie-Bibliothek über
liefert, bringt Eintrag 108 die erste sichere Datumsangabe:
Anno D (o m i)- n i 1581 feria tercia post festum S. Joannis Baptistae.Daß die Handschrift jedoch bereits spätestens im Jahre 1580 angelegt worden war, beweist B latt 4 der „Sporni iki Łańcuckie“ . Dieses B latt paßt in Papier, Format und Schriftcharakter auffallend und eindeutig zu den ersten Einträgen unseres Bandes dazu, so daß ohne weiteres anzunehmen ist, daß w ir es m it einem der beim Tatarensturm verlorengegangenen Teile desselben zu tun haben. Und so ergibt sich — unter Berücksichtigung der Angaben jenes Symon Gebauer — die weitere Folgerung, daß sich entweder die Handschrift damals in Łańcut oder Gebauer sich in Krzemienica befunden haben muß.29) Dortselbst kam sie unserem Gewährsmann zu Gesicht, fiel dann m it anderen Handschriften in die Hände der Tataren, wurde arg mitgenommen und verschleppt, aber durch ein günstiges Geschick vor gänzlicher Vernichtung bewahrt. Die übriggebliebenen Reste sam
melte dann — so weit als möglich — Symon Gebauer und so kam gerade jenes B latt vom Jahre 1580 noch auf uns. Indem ich die Numerierung von früher fortführe, gebe ich es hier wieder:

Ein merkwürdiger und gewißlich jetzt nicht mehr so unwahr
scheinlich erscheinender Umstand ist es, daß gerade zwei folgende Seiten des Schöffenbuches (p. 108 u. 109) zusammengeklebt wurden und der

sprang, beinhalten doch gerade diese beiden Seiten einen Eintrag, der sich von der Datumsangabe bis zum Schlußwort völlig m it unserem Eintrag 23 deckt, nur daß an Stelle der
„m agnijica Domina Anna Pilecka de Sienno“der „
magnificus Dominus Christopherus Pilecky de Pilcza“erscheint.
Nach Syrnon Gebauers öfters erwähnter Angabe fand nun der Ein
fall der Tataren am 16. Juni 1 6 2 2 statt, nach Ulanowskis Angabe (vgl. o. Anm. 2) jedoch reicht das Schöffenbuch bis in das Jahr 1 6 2 3.
Diese Annahme Ulanowskis widerspricht meiner oben aufgestellten An
sicht, daß dieser 2. Band unserer Schöffenbücher den Sturm des Tataren
einfalles selbst mitgemacht habe, völlig. Er stützt sich auf die Jahres
eintragung „Anno 1623“ auf Seite 450 der Handschrift, übersieht aber vollständig, daß die Zahl m it einer ganz anderen Tinte und Schrift und von einer viel späteren Hand geschrieben ist. Die unmittelbar vorher
gehende Datumsangabe lautet:
„ I n anno filecissime auspicato 1622 die vigesima quarta F e b ru (a rii)“ ,an sie schließt sich unmittelbar unsere herangezogene Stelle:
„A ctum feria quinta p ( r o ) x ( i) m a ante festum D iu i Gregori Papae“ .Das Fest dieses Heiligen fä llt nun in den M ä r z , reiht sich also ganz ungezwungen an und gibt uns als letzte Datumsbezeichnung der Handschrift das Recht, die Eintragungen m it diesem Tage für ab
geschlossen zu betrachten. Damit verlieft die Jahreszahl 1623 und mit ihr Ulanowskis Angabe jede Berechtigung, und es steht nichts im Wege, anzunehmen, daß am Tage des Tatarensturmes unsere Handschrift den plündernden Horden in die Hände fiel. Ihre weiteren Schicksale dann können wir freilich nicht mehr verfolgen.
2. Zu den Familiennamen.
Dieser Abschnitt soll — als ein weiterer Baustein für das noch zu schaffende Namenbuch der ersten deutschen Kolonisten auf dem polni
schen Siedlungsgebiet — vor allem das Namengut der weiteren schöffen
gerichtlichen Eintragungen aus Krzemienica von 1581—1600 beibringen.
Es zeigt sich deutlich, daß die Doppelnamen bereits vollständig fest
geworden (vgl. meine Bemerkungen darüber in der Einleitung zur Edition) und auch in ihrer Schreibung keineswegs mehr so schwankend sind, wie etwa ein Jahrhundert früher. Der Anteil polnischer Namen ist noch gering und auch der Einfluß der polnischen Sprache auf die ortho
graphische Wiedergabe noch kaum fühlbar. Diese Momente treten erst nach dem Jahre 1600 in stärkerem Maße auf, und es soll die Aufgabe einer besonderen Studie sein, diese Erscheinungen näher zu beleuchten.
Hier begnüge ich mich damit, diese Namen in alphabetischer Folge in derselben A rt wiederzugeben, wie ich dies bereits fü r das älteste Schöffen
buch im Namenregister der Edition [p. 207—221] getan habe, d. h.:
erst erscheint der Name in seinen verschiedenartigen Schreibungen, dann folgen die einzelnen Eintragsnummern, denen wiederum jeweils die An
gabe des Amtes, Vormundschafts- oder Verwandtschaftsverhältnisses
beigefügt ist. Gleichzeitig sind auch die Namen aus den oben abgedruckten
„Spominki Łańcuckie“ in das Register hineingearbeitet und tragen die Bezeichnung Ox, 0.2 --- .
